Site Terms & Conditions

1. Agreement to Terms

These Website Terms and Conditions (“Terms”) govern access to and use of www.navitrip.com (the “Site”) and related booking, messaging, and technology services (collectively, the “Services”) operated by Navitrip LLC (“Navitrip,” “we,” “us,” or “our”).


By accessing or using the Services, you agree to be bound by these Terms and the Navitrip Privacy Policy. If you do not agree, you must discontinue use of the Services.


2. NaviTrip’s Role

Navitrip is a travel technology and booking facilitation platform that enables reservations for lodging and accommodations offered by independent hotels, property owners, wholesalers, and travel suppliers (“Suppliers”).


Navitrip does not own, operate, manage, or control any hotel or accommodation listed on the Site. Accommodations are provided solely by Suppliers.


3. Eligibility and User Responsibilities


You represent that you:

  • Are at least 18 years of age
  • Have legal authority to enter into these Terms
  • Will provide accurate and complete booking information
  • Will comply with all applicable Supplier policies


You are responsible for ensuring that all booking details, including traveler names, dates, occupancy, and special requests, are accurate at the time of booking. Errors or inaccuracies are not grounds for refunds or chargebacks.


4. Bookings and Contractual Relationship

When a reservation is made through the Site, the contract for the accommodation is between the traveler and the applicable Supplier.


Navitrip’s role is limited to facilitating the reservation, transmitting booking information, and, depending on the booking model, processing payment.


Supplier terms governing cancellations, no-shows, refunds, taxes, fees, and property rules apply once a reservation is confirmed.


5. Bookings Made by Travel Agents or Authorized Representatives

Some reservations made through the Services are completed by travel agents, advisors, or other authorized representatives (“Booking Agents”) acting on behalf of travelers.


By making a reservation on behalf of another individual, the Booking Agent represents and warrants that they have full authority to:


  • Act on behalf of the traveler
  • Accept these Terms and all applicable Supplier policies on the traveler’s behalf
  • Provide accurate traveler and reservation information


The traveler is bound by all terms, conditions, policies, and restrictions accepted by the Booking Agent, including cancellation policies and no-show rules.


Navitrip may rely on the instructions and representations provided by the Booking Agent and is not responsible for errors, omissions, or misrepresentations made by a Booking Agent.


6. Payments and Merchant of Record


The merchant of record (“MoR”) varies by booking and is disclosed during the booking and payment process.


  • For some bookings, Navitrip acts as the merchant of record and charges the payment method directly.
  • For other bookings, the hotel, Supplier, or a third-party travel partner is the merchant of record and charges the payment method directly.


Regardless of merchant-of-record designation:


  • Navitrip is not the provider of the accommodation
  • Supplier policies govern the stay and on-site experience
  • Responsibility for the property and services remains with the Supplier


7. Cancellations, Changes, and No-Shows

Each Supplier maintains its own cancellation, modification, and no-show policies. These policies apply regardless of merchant-of-record structure.


Failure to cancel within the permitted timeframe or failure to check in may result in charges up to the full booking amount. Navitrip does not have authority to override Supplier policies except where expressly stated during booking.


8. On-Site Issues and Supplier Responsibility


Suppliers are solely responsible for:


  • Providing the booked accommodation
  • Property condition, cleanliness, safety, and suitability
  • Guest services and on-site issue resolution


All on-site issues must be addressed directly with the Supplier. Navitrip does not control hotel operations and does not guarantee guest satisfaction.


9. Room Assignments, Substitutions, and Availability

Room types, bedding, views, layouts, and specific room locations are not guaranteed unless expressly confirmed by the Supplier.


Suppliers may assign alternate rooms at check-in due to operational needs or availability, provided accommodations are of comparable or greater value as determined by the Supplier.


10. Hotel Relocation (“Walk”) Situations

In rare circumstances, a Supplier may be unable to honor a confirmed reservation and may arrange alternative accommodations.


Any relocation or substitute accommodation is determined and managed solely by the Supplier. Navitrip is not responsible for differences in accommodations, additional costs, or guest satisfaction.


11. Photos, Descriptions, and Amenities Disclaimer

Property photos, videos, descriptions, and amenity listings are provided by Suppliers and are representative only. Actual accommodations may vary.


Differences between displayed content and the actual accommodation do not constitute grounds for refunds or chargebacks against Navitrip.


12. Chargebacks and Payment Disputes

If a charge is disputed, you agree to first attempt resolution directly with the Supplier.


Chargebacks related to accommodation performance, room condition, amenities, service quality, overbooking, relocation, or on-site experience are disputes between the traveler and the Supplier.


Where Navitrip is the merchant of record, Navitrip may provide booking confirmations, Supplier policies, and transaction records to payment processors or issuing banks.


13. Force Majeure

Navitrip is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, government actions, labor disputes, epidemics, pandemics, power failures, or telecommunications outages.


This does not apply to hotel overbookings or operational decisions, which remain the responsibility of the Supplier.


14. Prohibited Uses

You may not make fraudulent bookings, circumvent policies, scrape the Site, or interfere with Site security or operations. Navitrip may suspend or terminate access for violations.


15. Disclaimers

The Services are provided on an “as-is” and “as-available” basis without warranties of any kind.


16. Limitation of Liability

To the maximum extent permitted by law, Navitrip is not liable for acts or omissions of Suppliers or for indirect or consequential damages. Liability, where not excluded, is limited to the amount paid to Navitrip for the applicable booking.


17. Indemnification

You agree to indemnify and hold harmless Navitrip from claims arising out of your use of the Services or violation of these Terms.


18. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Delaware.


19. Modifications

Navitrip may update these Terms by posting a revised version. Continued use constitutes acceptance.
